Applying to Establish a Renewable Energy Generation Business

To achieve net-zero carbon emission goals and address power supply instability, Taiwan's renewable energy, energy storage, and green energy industries have been booming. To better develop and manage the nation's power resources, the government has also been actively driving energy transition policy in recent years, encouraging diverse electricity supply and boosting market activity.

Under the Electricity Act and the Regulations Governing the Installation and Management of Renewable Energy Generation Equipment, renewable energy equipment is mainly divided into three types based on installed capacity and use:

  • Type 1: Generation equipment installed by a power generation business under the Electricity Act and related regulations
  • Type 2: "Self-use" generation equipment installed under the Electricity Act and related regulations
  • Type 3: Self-use renewable energy equipment with an installed capacity under 2,000 kW (2MWp)

Type 3: The Most Common Application Category

The most common type of renewable energy generation equipment is Type 3 — as long as the installed capacity is under 2,000 kW, individuals, companies, and organizations alike can apply.

The Type 3 application process is as follows (this is a simplified overview; actual procedures depend on individual circumstances):

Type 1: Requires a Power Business License

Once installed capacity, combined, reaches 2,000 kW and you intend to supply power directly or via wheeling, the equipment falls under Type 1 renewable energy generation equipment ("Type 1"), and you must apply to the Bureau of Energy under the Electricity Act for an establishment permit and construction permit before construction can begin, and ultimately obtain a power business license.

The Type 1 application process is as follows (this is a simplified overview; actual procedures depend on individual circumstances):

When applying for the establishment permit, under Article 3 of the Electricity Business Registration Rules, the following five documents must be prepared:

  1. Establishment plan
  2. Environmental impact assessment documentation
  3. Local authority consent letter
  4. Land development consent documents and land administration authority opinion
  5. Documentation of consent for power line connection from the plant
